Judicial Review in Palestine

This article was issued in 1996 by the Birzeit Law Center; it aims to consider the contours of judicial review for Palestine. It also attempts to compare various systems of judicial review within the common-law and civil-law traditions to suggest which judicial features, structures, and processes would benefit the implementation of judicial review in Palestine. Further, it tackles the creation of the Palestinian constitution, the enumerated powers of the judicial system, and outlines the various options for the Palestinian state to consider when devising a system of judicial review. Moreover, it examines the advantages and disadvantages of each system in terms of protecting fundamental rights and freedoms within the Palestinian society. Finally, it presents a proposal for establishing a Palestinian constitutional court with the power to exercise judicial review.
