Legislative Harmony in Palestine: A Preliminary Survey

The research study handles two major issues, the first one focuses on the legislation and regulations consistency with the basic law, modified, for the year 2003, in form, while the other concentrates on the legislation consistency with the above mentioned basic law in content. The research is divided into five chapters,


Chapter one deals with the theoretical backgrounds of the legislative inconsistency case.
Chapter two presents both the subjective principles and the required legislative procedures as set forth by the basic law.
Chapter three brings some practical applications on cases of legislative inconsistency of some Palestinian legislation with the Basic Law both in form and content. To mention the criminal procedures law Number 3 for the year 2001, the printed materials law number 9 for the year 1995, the Election law Number 13 for the year 1995 and the internal bylaw of the Palestinian Legislation Council (PLC).


Chapter four of the research study introduces some legal solutions for the cases of proved inconsistency or lack of harmony of some legislation with the basic law.


Chapter five proposes revision mechanisms purposed to reveal and prevent any possible legislative inconsistency with the Basic Law both in form and content.


As a conclusion the research reveals the existence cases of inconsistency of some Palestinian legislation with the basic law, whether laws or bylaws, the matter that requires a direct intervention by the legislature (whether PLC or the executive authority) to reform such cases through amendment or annulment of the unconstitutional legislation.
